Filing complaints
Any person, other than EULEX Kosovo personnel, claiming to be the victim of a violation of human rights by EULEX Kosovo in the conduct of EULEX Kosovo’s executive mandate is entitled to file a complaint. The HRRP will examine complaints relating to such alleged violations that occurred since 9 December 2008 in Kosovo. A complaint must be submitted to the HRRP within three months from the establishment of the HRRP, or respectively, within six months from the date the alleged human rights violation occurred, whichever is more favorable to the Complainant. The role of the HRRP is linked to the duration of the executive mandate of EULEX Kosovo. The HRRP may act for a limited supplementary period of time after completion of the executive mandate of EULEX Kosovo. How to file a complaint? Reviews by the HRRP will be based on written information submitted to the panel. If the HRRP finds that the complaint cannot be reviewed merely on the basis of written information but that such review also necessitates oral presentations, the HRRP might receive such oral presentations. Anonymous complaints will be rejected. After the review of a complaint, the HRRP will present its findings, including possible recommendations, to the Head of Mission. The Head of Mission will inform the Civilian Operations Commander and the Member States as well as other contributing States. The Complainant will be informed by the HRRP whether the HRRP has found that EULEX has violated the human rights of the Complainant. The HRRP will provide reasons for its findings. Findings and recommendations of the HRRP will be made public, unless their publication could affect the operational effectiveness of the EULEX Kosovo Mission or the security of the Mission's personnel. |
