Filing a complaint

Who can file a complaint?

Any person, other than EULEX Kosovo personnel, claiming to be the victim of a violation of human rights by EULEX Kosovo in the conduct of EULEX Kosovo’s executive mandate is entitled to file a complaint.

A complaint must be submitted to the Panel within six months from the date the alleged human rights violation occurred. The role of the Panel is linked to the duration of the executive mandate of EULEX Kosovo. The HRRP may act for a limited supplementary period of time after completion of the executive mandate of EULEX Kosovo.

Procedure with the Panel

Reviews by the Panel are based on written information submitted to the panel. If the Panel finds that the complaint cannot be reviewed only on the basis of written information, the Panel may organise an oral hearing. Anonymous complaints are rejected.

After the review of a complaint, the Panel presents its findings, including possible recommendations, to the Head of Mission of EULEX Kosovo. The Head of Mission informs the Civilian Operations Commander and the Member States as well as other contributing States.

The Complainant is informed by the Panel whether it has found that EULEX has violated the human rights of the Complainant. The Panel provides reasons for its findings. Findings and recommendations of the Panel are made public, unless their publication could affect the operational effectiveness of the EULEX Kosovo Mission or the security of the Mission's personnel.
